Basically the Court of Appeal couldn't find evidence that the BAR team intentionally cheated which would have meant excluding BAR from the championship.

But what they didn't like was BAR trying to mislead the Stewards when asked to empty the fuel tank and that BAR failed to clarify the potenital of this situation to occur with the FIA before hand.

There was a problem with the procedure. That could be interpreted as misleading but it could be a simple misunderstanding.

And when the car was drained fully the team still proved that car was overweight. So what is the fuss about ?
BAR not clarfifying this condition with the FIA. OK maybe they should have but they didn't. So ? That doesn't make them in the wrong.

Michelin didn't clarify with the FIA the issue of the groove measurements. When Bridgestone/Ferrari complained they clarified the rule and didn't ban Michelin for two races. The same should have happened. Clarify the weight rule and then BAR would comply according to the clarification.
I'm back and yes supporting Alonso "The Cute" in the Ferrari!

BAR will not take the matter any further as they couldn't find a way to race this weekend at the Spanish Grand Prix
B?A?R Honda has looked at all practical ways of immediately challenging the decision. The central issue is one of jurisdiction. Jurisdiction in Europe is governed by European-wide rules, which say that a defendant party has a right to be sued in the territory in which it is based. Upon receiving the best legal advice in all relevant jurisdictions, the conclusion is that nothing can be done to enable the team to race this weekend.

B?A?R Honda has considered whether to pursue further action which might enable it to compete at Monaco. On balance, the team has decided that to challenge the sport's governing body would cause a level of disruption and damage to the sport which would not serve the best interests of everyone involved. B?A?R Honda will be discussing the ramifications of the Court of Appeal verdict with the other teams and manufacturers involved in the sport.
